Spain to Require Energy Performance Certificates for Homes in June 2013

From 1st June 2013 the Spanish government is introducing legislation that requires all homeowners advertising their property for sale in Spain to be in possession of an Energy Performance Certificate.
The law brings Spain into line with the EU and is similar to the requirement for sellers in the UK. Fines can apply to homeowners who have their properties advertised for sale without an energy certificate. Under the Spanish consumer protection act the fine can range from 3000 Euros upwards.
Unfortunately as with other means of "raising taxes" in Spain it is the non resident owners that suffer most. Many people have recently been caught out by the additional MMV tax. Letters have been delivered to addresses in Spain and when not responded to within a few weeks additional taxes have been applied for which there is no means of appeal. We have no doubt that wherever possible the Spanish authorities will seek to raise this revenue to boost their public finances.
An energy certificate costs around €250 for an apartment, slightly more for a villa. Anyone wishing to advertise their property through our resale service will need this certificate.
